No kidding: David Ortiz is being sued by Jay-Z

According to, hip-hop mogul Jay-Z (and his associates) filed a suit Thursday in Manhattan federal court accusing Red Sox first baseman David Ortiz of “marketplace confusion and damage” for opening a “Forty/Forty” night club in the Dominican Republic.

Jay-Z owns like-named “40/40” clubs in New York City, Las Vegas and Atlantic City along with business partner Juan Perez. 

“David Ortiz is fully aware of plaintiff’s Manhattan 40/40
Club, since he had been a patron there on several occasions long before
he opened his infringing Forty/Forty Club,” reads the suit.

Jay-Z is well known for being a Yankees fan, and even claims to have made the “Yankee cap more famous than a Yankee can,” in the criminally overplayed “Empire State of Mind.”  There’s probably a joke to be made here about New York pulling a fast one on Boston, or the Red Sox copying off the Yankees yet again, but this story really is plenty funny all by itself.  And Big Papi is struggling enough at the plate.

    Are laws donot apply in other countries however if jay-z has an international copy right or patton on the name maybe hes got an argument we will see.

    Why Have all these comments turned in to a war of race between all black racists AND white racists? Black people should not be offended by my comment because if you put white racists on one side and black racists on the other side, It would be pretty equal.

    How is Jay Z “your man”? By the way, Jose Canseco was the 1st 40/40 baseball player. He owns the right to use 40/40. Not some uneducated idiot who happens to be able to rhyme a couple of words!

    I can’t sit here and read every post while at work… Does anyone see that the article clearly shows 40/40 vs forty/forty? Aren’t those two completely different things? Even if Jay Z has some sort of patent or legal rights to the name, it technically is different. I mean, I imagine some people will tell me that its just semantics, but how could you copy someone when you have a different end result? It could be similar but I doubt this lawsuit will stand.
    Furthermore, would he have started the lawsuit if a Yankee made the same restaurant???

    First of all, I’m stunned at the level of racism displayed over something as insipid as Jay Z suing David Ortiz over the name of a nightclub! I mean, are you people that can’t stand black people and have to sound like hillbillies using the ‘N word’ aware that it’s the year 2010?! Hasn’t socially-conscious evolution lifted us all up a little higher than that?! Hasn’t PERSONAL evolution lifted you up a little more than having to attack someone’s race in an issue?! This isn’t 1925, for God’s sake! What difference does it make that Jay Z is black, (whether you think he’s intelligent or talented or not), or that Ortiz is Dominican (again-whether this issue displays his ignorance or not!)? BOTH of them have exhibited enough talent in their chosen professions to make a boat load of cash and while I personally think Jay Z is just suing to get Ortiz exposed for being someone that can’t come up with a good name themselves and possibly trying to capitalize on Z’s club name, what does Jay Z’s looks or the fact that you can drawl the n word in an Internet forum have to do with it?! I mean, any attorney worth a nickle should’ve told him his suit won’t hold water in the D.R..
    But no. People have to practically brag about their ignorance by calling a black man something hateful. Hatred has to be a part of the issue now. And they have to hide behind fake initials and internet names to do it because they haven’t got the balls to do it and stand up for what they say, or the ability to discuss an issue with a modicum of intelligence, proving they haven’t the sense God gave a goat.
    Because even goats don’t care if one’s black and the other’s white… and if they do, they don’t show a bit of hatred over it.
    Grow up, people. Evolve. You’re ALL better than that!

    I am dominican and that david have the right to name his nightclub 40/40 because that is dominican we can use any name we want but what happen if that name was use in china what will he sue china to but he need to get over it and continue his life of what he was doing and stop worrying about this stupid name P.S Yankee sux
