No kidding: David Ortiz is being sued by Jay-Z

Apr 15, 2010, 8:08 PM EDT

According to ABCNews.com, hip-hop mogul Jay-Z (and his associates) filed a suit Thursday in Manhattan federal court accusing Red Sox first baseman David Ortiz of “marketplace confusion and damage” for opening a “Forty/Forty” night club in the Dominican Republic.

Jay-Z owns like-named “40/40″ clubs in New York City, Las Vegas and Atlantic City along with business partner Juan Perez.

“David Ortiz is fully aware of plaintiff’s Manhattan 40/40
Club, since he had been a patron there on several occasions long before
he opened his infringing Forty/Forty Club,” reads the suit.

Jay-Z is well known for being a Yankees fan, and even claims to have made the “Yankee cap more famous than a Yankee can,” in the criminally overplayed “Empire State of Mind.”  There’s probably a joke to be made here about New York pulling a fast one on Boston, or the Red Sox copying off the Yankees yet again, but this story really is plenty funny all by itself.  And Big Papi is struggling enough at the plate.

So, Jay-Z is further cementing his legacy as a douchebag?

  2. Bill - Apr 16, 2010 at 4:14 AM

Nobody does that to Jay-Z and gets away with it.

  3. DAVID - Apr 16, 2010 at 7:44 AM

does jay-z has the legal rights to the name in the dominican republic?

This one’s totally different. This numbers of this one represent the number of times he’ll strike out per month and the amount of DNP-CD’s he’ll rack up this year on his way to next year’s unemployment.

Looks like Papi got a little sloppy…when it came to naming his night club. Seriously, how could he think he’d get away with this?

I didn’t have much luck finding affordable health coverage with the limited amount of providers in my area until I shopped with ( http://ta.gg/48p ) and found a great rate with an A plus company. Now my kids have coverage they deserve. I was also paying way to much for life insurance until I found ( http://ta.gg/4c2 ) Within minutes I got quotes from 4 agents that saved me $60 a month on life insurance. I can’t believe how easy it was to get a quote and as the website says fast, easy and just a click away and the agents were so nice and helpful.

Some pretty funny comments about Ortiz , he did infringe but in another country , and J has more money than god ,this is nothing more than a “mine is bigger than yours” on both parties. Change the name , hit some homeruns and beat the Yankees … all water under the bridge! This issue is really not that serious!

  9. robyn - Apr 17, 2010 at 6:44 AM

I cant stand Jay-Z. For starters he is ugly,He looks like a gorilla. His nose nostrils are disgustingly huge. And I do not understand why people think he has a nice singing voice, he doesnt. He’s obviously a good business person hence the money he makes. But what a douchbag

  10. maryj - Apr 17, 2010 at 6:51 AM

So tell me- does Jay-Z now owns the world?

  11. mike - Apr 17, 2010 at 6:56 AM

I’m still trying to figure out why either one of these doushebags have the money to open a toilet let alone a nightclub.

  12. Scott - Apr 17, 2010 at 7:23 AM

Really Jay-Z????? Do you have nothing better to do. Two clubs in two different countries same name who cares. There different states that have the some of the same name towns/cities and there are no lawsuits. Get a life Jay-Z. And as far as making the Yankee hat more famous than any Yankee…..PLEAAASEEEEEEEEEEEEEEEEEEEEEEEEEEEE

  13. steve - Apr 17, 2010 at 7:32 AM

this reply is to “mike”: because obviously they learned how to spell and also unless you are retarded or live under a rock pro ball players make millions and jay z is one the biggest entertainers out there…so next time you might want to skip making a comment because you look stupid. good day

  14. Sue - Apr 17, 2010 at 7:46 AM

    Get over yourself Jay-Z-really….

  15. jp - Apr 17, 2010 at 7:49 AM

He probably owns a Trademark on 40/40 which is covered internationally…
Scott… city and town names can’t be trademarked thus no lawsuits….
BTW i am suing you for using the same name as me… you must be living in the Dominican republic

  16. ttrexxx - Apr 17, 2010 at 7:49 AM

a Pimp by any other name

  17. will - Apr 17, 2010 at 7:53 AM

Hopefully Jay-Z will win so that he and his Buckwheat associates can put the money to better use for the music industry. They have already ruined the industry with their Top 40 hip hop/rap garbage. Please go away!!!!!

  18. mike - Apr 17, 2010 at 8:02 AM

    #1 I wouldn’t call Big Papi a “pro”
    #2 I wouldn’t call Jay-Z an “entertainer”
#3 I just wanted to know who are paying these losers, that’s all
    #4 Good Day….Doushe

  19. doug - Apr 17, 2010 at 8:04 AM

big papi should just punch him in the face

  20. steve - Apr 17, 2010 at 8:15 AM

its in another country , it wont stand

  21. Michael - Apr 17, 2010 at 8:15 AM

When does Billy Joel’s lawsuit begin for Jay Z’s thinly veiled theft of a song title? How imaginative, substituting “Empire” for “New York.” What a creative gift.

  22. Craig - Apr 17, 2010 at 8:18 AM

I agree with you David, You can do anything in the DR….need no licenses……lets see I can go to 40/40 in NY? or DR? How about neither.
Jay-Z you are an ass…..hip hop/crap music. You are a fraud……Red Sox fan here but you making the Yankees cap more famous…….arrogance personified….step in front of the common man and get your ass kicked.
Ortiz needs to cooncentrate on playing ball….oh by the way they also don’t have correct Birth Certificates in the DR….How old would you like to be? Same with the people coming from asia…These 25 yr olds are only 18..

  23. blank - Apr 17, 2010 at 8:18 AM

Jay-z don’t you have better things to do? C’mon. Unless he has a international trademark why is bothered by this? It’s just stupid.
He acting like annoying 3-year-old to put it.

  24. bob - Apr 17, 2010 at 8:26 AM

Jay-who? He thinks he’s bigger than the Yankees? Gotta stop using that crack. It messes you up.

  25. william - Apr 17, 2010 at 8:29 AM
