No kidding: David Ortiz is being sued by Jay-Z

According to ABCNews.com, hip-hop mogul Jay-Z (and his associates) filed a suit Thursday in Manhattan federal court accusing Red Sox first baseman David Ortiz of “marketplace confusion and damage” for opening a “Forty/Forty” night club in the Dominican Republic.

Jay-Z owns like-named “40/40″ clubs in New York City, Las Vegas and Atlantic City along with business partner Juan Perez. 

“David Ortiz is fully aware of plaintiff’s Manhattan 40/40
Club, since he had been a patron there on several occasions long before
he opened his infringing Forty/Forty Club,” reads the suit.

Jay-Z is well known for being a Yankees fan, and even claims to have made the “Yankee cap more famous than a Yankee can,” in the criminally overplayed “Empire State of Mind.”  There’s probably a joke to be made here about New York pulling a fast one on Boston, or the Red Sox copying off the Yankees yet again, but this story really is plenty funny all by itself.  And Big Papi is struggling enough at the plate.

    Sorry but the names are different,and if he is such a good businessman and wanted to protect his image then he should of trademarked the name and all the variables. Since he is in a business that does this all the time then he should of been smarter. Things like this suck anyways..people taking common words and making them their own…maybe baseball should sue him also as I think they used the 40/40 wording first.

    It is a shame that Tupak was killed with three empty seats in the back of that BMW. Jay Z could have been a guest. JAY Z is an arrogant jerk. He got lucky because as ugly as he is(he looks just like Camel Joe)he could play Freddie Krueger roles and make Freddie look good.

    Wow, what a racist lot! Luckily many of you have ignorance to balance out your racism. And when you post your legal opinions, please include where you got your J.D. That stands for “juris doctor,” and it means “law degree.” If you don’t have one, then your legal opinion is pretty much worthless. The law is what is written in the codes and statutes and is interpreted by judges, not what you think it should be.
    And to the brilliant Adam, who posted this: “if he had any bit of an education held know the 40(fourty) and forty arent the same thing so not sure how well he do in this suit.” I applaud you for having the courage to still use “fourty,” which was only used in Middle English, from around 1090 to 1470. Most people today insist on using the Modern English spelling, “forty.”

When a no talent, celebrity wannabe like Jay-Z (which he uses since he can’t remeember his name)wants more pulbicity, he goes after a real celebrity like the athlete Ortiz.     Also JayZ has a copyright on 40/40 and probably all likenesses of the 40/40 logo. It would be like a bootleg McDonalds opening up under the Scottish name MacDonalds…Big Papi’s club will most like have to change its name.

    This is a little bit of overkill. The club is in another country. I agree if he has something pertaining to International Law prohibiting this name to be used that would be a reason for him to sue. I do not think Mr. Ortiz is trying to associate his club in the Dominican with Jay-Z’s. Other than that some of the comments here are either Racist or Ghetto. That’s Sad.

    It should not matter what he names the club in the DR. The case will probably be dropped because he owns the rights to a US ONLY club chain. These naming rights shouldnt apply to DR.
