No kidding: David Ortiz is being sued by Jay-Z

According to ABCNews.com, hip-hop mogul Jay-Z (and his associates) filed a suit Thursday in Manhattan federal court accusing Red Sox first baseman David Ortiz of “marketplace confusion and damage” for opening a “Forty/Forty” night club in the Dominican Republic.

Jay-Z owns like-named “40/40″ clubs in New York City, Las Vegas and Atlantic City along with business partner Juan Perez. 

“David Ortiz is fully aware of plaintiff’s Manhattan 40/40
Club, since he had been a patron there on several occasions long before
he opened his infringing Forty/Forty Club,” reads the suit.

Jay-Z is well known for being a Yankees fan, and even claims to have made the “Yankee cap more famous than a Yankee can,” in the criminally overplayed “Empire State of Mind.”  There’s probably a joke to be made here about New York pulling a fast one on Boston, or the Red Sox copying off the Yankees yet again, but this story really is plenty funny all by itself.  And Big Papi is struggling enough at the plate.

    These two avid capitalists should settle amicably and immediately. All they’re really doing is wasting money on lawyers that would otherwise be redistributed to folks who truly deserve the social justice of receiving their ill gotten gains garnered from the pockets of the poor who buy their merchandise and pay to see them in action.

So don’t hate, appreciate! And trust…Jay-Z (being from the nasty projects…not too far from where I lived) would handle you easily. With or without the police!

    I really dont know where to begin! This is only the 2nd time I’ve commented on one of these boards and I’m going to try to make this as short as possible. It is really sad/hurtful for me to see all this garbage that fills the heads of “a lot” of people. Such ignorance and hatred is frightening. The issue is the suit that Jay-Z & camp is filing against Ortiz for infringement of a business name. I’m sure that Jay-Z didnt personally tell his camp to sue, it was probably more like the people that he pays to protect his business were doing what they are paid to do and brought this to his attention. I’m not sure that Ortiz intentionally used a variation of Jay-Z’s club name with hopes that it would be confused with Jay-Z’s club and thus ensure its profitablility. That will be fought out in the courts by people who are licensed and knowledgable(on both sides)in that area of law. The personal attacks (cloaked as comments) regarding the music, the physical appearance, the right to have the money that both these men have “earned” is sad. I personally applaude anyone who can come from any background and achieve the success that both these men have achieved. Their journey has been long and I’m sure difficult at times, but they both persevered and did not quit! It is especially enlightning for other individuals who come from similiar backgrounds to know that with discipline and perseverance and always learning through their journey that they can also achieve their dreams. I also must add that “personally”, I prefer men with full lips that can administer a kiss that’s soft, pliant and “cushioned” and does not always require that we open our mouths to prevent cracking or knocking into teeth! I prefer “broad noses” that dont stab during that “sensuous” closed mouth “sugar”! So all of you (and you know who you are) that have soo much to say about their physical appearance, thank all the Gods that you dont define beauty!! For all who are attacking these men and their personal lives (you know who you are), you WISH you were close enough in these circles to have some personal insights. But of course we know that you’re not!! I don’t have to speak on your ignorance, you’re doing a great job on that all by yourselves. What I do know is what your destiny is!! The energy you put out there, is the energy that will come back to you, and that energy will govern where your life and the quality of it will lead you!! So, we know where all of you (and you know who you are) will be!! That’s tooo bad for all of you….But sweet revenge for all of us (and we know who we are)!!!

    Stop hating on both of them. If he has a case then it will got to court, if not then life will go on. If half of you put as much energy into bettering yourself as you do talking trash about people who are doing better than you,you could tell Ortz, Jay Z and Bill Gates (maybe even Mac) to kiss your ass. Get on your A game while they stay on their’s. Oh by the way, the hat sales for Yankee caps when up significantly once Jay Z was photographed wearing one on more than one occasion. So yea, he can make a Yankee cap hotter than a Yankee can. I’m not even a fan and I must give credit where it is do.

    Jay-Z is absolutely 100% right, he is protecting his interests. If any one of you is saying that you would not do the same you are lying and you know it. Jay-Z is a brand, he is a business, and whether you like it or not and whether you like him or not, whether I like him or not is totally irrelevant. He is within his rights to protect his brand. It wasn’t free for him, why should Ortiz capitalize off of what Jay-Z has built? Why is he scum, because he left the streets to become a tax paying, law abiding, productive citizen, who has created an empire thereby employing many in countless communities? Or because when he went to Africa to perform he first went to a village and walked to a watering hole with a little African girl, the watering hole was over three miles from her home, Jay-Z discover that this water was shared with animals, he also realized that upon returning home the little girl then had tomake the long trek to school, he, Jay-Z, the “scum” had the gall to put in a system that not only brought the water to the village, but it treated the water as well, and of all the uppity, scummy things he could do, he had the audacity to do this for more villages and EVEN get this, start a campaign and (you’ll love this) he called it WATER FOR LIFE! the scum bastard how dare he! We are so blessed that there are not more like him.
    Sue him Jay-Z if he wants a clubs that brings in millions of dollars annually as yours does let him build it and it’s reputation as you did from the bottom up, all you really need is an EMPIRE STATE OF MIND! Any business person worth their salt knows you are right and would support you 100%.

    I don’t have a dog in this fight but I am convinced this country is doomed with all the hatred and ignorance. With that said, before you start preaching about someone’s grammar and writing skills you might check your own. You started with a question, but didn’t use a question mark. You misspelled “alot”, not a word but two words. And preaching about hatred and use “inbred cousins” in the same post is hypoctrical. Don’t you think?
    I also find it interesting there is so much hate coming from New York and Boston, the media’s darling cities. You all are suppose to be so “open minded”, what happened to that? Just another reason for me to be happy I live in Texas.
