The suit isn’t over Krawczynski saying Spooner made a bad call or anything like that, but rather Spooner is alleging that Krawczysnki fabricated potentially damaging quotations. If Krawczynski had just said “That must have been a makeup call”, I don’t think we would be in this situation

There are instances when they’ve tried to shoehorn defamation suits into other legal theories, but I don’t think they’ve been successful. The actual defamation claim is deemed a personal tort and dies with the person whose reputation was allegedly sullied.
