Without the Dodger Debacle, MLB is doing well through tough economic times, with minimal attendance drops. A Chapter 11 proceeding is a rehabilitative measure, whereby business are allowed to reorganize themselves in a manner that gives them the best chance to be profitable and survive post-filing. The entire business model of a sports franchise requires fans to attend games, watch their team on television, and purchase merchandise. When an entire fan base revolts against its team because of the team’s owner, then the ability to survive post-bankruptcy is a very serious question. If McCourt couldn’t keep the Dodgers out of BK when the stands were full, how does he propose to do so when he’s lost 10,000+ fans per home game, plus the untold amount of loss in TV viewership and merch sales. The fans protests are valid and material to the continuing operation of the Dodgers franchise under the debtor in possession (McCourt).
