Actually that's not entirely true.

The domain has to be registered with the intent to profit if they were to file suit under the Anticybersquatting Consumer Protection Act, but there is an alternative remedy available through ICANN. ICANN has a Uniform Domain Name Dispute Resolution Policy that virtually all domain registrars agree to be bound by in order to receive ICANN accreditation as a registrar.

The UDNDRP is an arbitration system that is available for trademark holders that does not require an intent to profit. In order to file a grievance with ICANN, the domain needs only to 1) be identical or confusingly similar to a trademark held by the complainant, 2) the domain owner has no legitimate rights or interests in the name, and 3) the domain has been registered and is being used in bad faith.

All three of those elements are pretty clearly met here, since the domain name is the park name, the domain owner isn't actually running any sort of business or operation called Jet Blue Park, and the fact that the domain points to the Yankees' site. If the UDNDRP arbitrator finds for the claimant, then they have the power to order reassignment of the domain name to the trademark holder.

Granted, there is no possibility of any extra damages award with this route, but it is an avenue the Sox could use to seize ownership of the domain.

As a Yankees fan since 1967 I can no longer sit here and take all of this Yankees/Red Sox "rivalry' BS. Listen up, there is no Red Sox/Yankees "Rivalry". The "rivalry" is a media driven, made up farce to drive up ratings. Here me out.

My Knicks have won a total of two (2) championships while the Celtics have won 17, SEVENTEEN, no one, NO ONE calls that a rivalry. These two teams play in the same place as their baseball teams but yet Knicks fans don't even attempt to talk trash when it comes to basketball.

So tell me, how in the hell is winning 2 championships in 90+ plus years , comparable to the Yankees 27, TWENTY-SEVEN!

Stop the madness, I get the close proximity of the teams (hell the entire Northeast is close), but stop all of this "rivalry" talk, its gotten to be a little nauseating.

Only BSPN cares about that crap, we the fans just root for our teams.

Go Yanks!
