Of course he’s not playing. He just got his “eligibility” restored to seek employment and doesn’t even have an employer yet. He doesn’t even know if there’s a market for his employment. The minor league system is jumping the gun, and I think he has every right to see if there’s even a market for him before they begin testing. Of course, his refusal and suspension ensures that there will be no market for his services. Would Craig take his case arguing restraint of trade, or whatever it’s called?

I am very sympathetic. I work in the petrochemical industry, and as such am subject to random testing (safety and security are the excuses; although it’s really a plausible argument for reduced liability). I despise the testing as an invasion of my privacy.

However, I recognize the term “condition of employment.” And the courts to date have not stood with the individual. So I submit to random tests.
