UPDATE: Michael Schwimer has not filed a grievance against the Phillies

UPDATE: Schwimer’s agent, Jeff Borris, tells Salisbury that no grievance has been filed against the Phillies. However, he did ask the MLBPA to investigate the matter. It’s still possible a grievance could be filed.

“I believed Michael could have been sent down while he was hurt so I turned the matter over to the union to investigate whether a potential grievance was there,” agent Jeff Borris said. “I haven’t heard anything since.”

Bob Lenaghan, assistant general counsel for the MLBPA, says the investigation is ongoing.

8:38 PM: Some of you may remember that there was a little bit of drama between the Phillies and right-hander Michael Schwimer earlier this summer after he claimed that he should have been placed on the disabled list with elbow soreness rather than sent to the minors. He eventually reported to Triple-A Lehigh Valley and finished the season there, but the issue isn’t completely in the rear-view mirror.

According to Jim Salisbury of CSNPhilly.com, the MLBPA has filed a grievance against the Phillies on behalf of Schwimer. Assuming it is successful, Schwimer could potentially be compensated for what he would have earned had he been on the disabled list.

Schwimer, who turns 27 in February, posted a 4.46 ERA and 36/16 K/BB ratio over 34 1/3 innings this past season. He is healthy now and remains on the Phillies’ 40-man roster.

      Well I mean, what if the guy really was hurt? I dont know the details of the situation but what if he really was screwed over by the team? The grievance could be serious here

      Exactly….I don’t care what you think of the merits of the case, the guy sucks.

      Ohhhh, and at the time he was sent down, they guy had gone 3 weeks with an ERA in the 3′s…..well below his career avaegae. If he was hurt when demoted, he shuold try to stay injured

        Nate Schierholz was coming off the DL, either Schimmer of Jeremey Horst had to go down to make room. Horst had a 1.15 ERA.

    That should be good for his worthless career. The guy never said he was hurt until they sent him to the minors because he sucked then his arm was sore. Normal x rays and MRI. OK now it’s time to sink or Schwim.

    Heh – everyone would give him the benefit of the doubt if it had been Scrooge McLoria who sent him down. The buffoon and the Chihuahua have a reputation for taking guys aside and threatening them with the minors for any number of reasons – often, right in front of their teammates. Just add that to the list of reasons why they’re so widely detested.

    No grievance was filed yet. Schwimer’s agent requested an investigation, but no grievance has been filed.

    I recall reading that a 2nd (and possibly a 3rd?) opinion were negative for injury before he reported to Lehigh Valley. Where is the basis for grievance?

    The phillies should file a grievance against Schwimmer for being an awful middle reliever… Chad Qualls while they’re at it as well

    I’m sorry. But the amount of additional money that he would have made would have been irrelevant to the phillies. If the league rules in favor of schwimmer it will set a vet bad precedent for all players to claim they are hurt before being sent down.
