They could take the pick away and refuse to approve the contract as punishment for attempting to circumvent the CBA.

After the draft, there is no pick attached to signing Bourn (i.e. a team wouldn’t have to give up its 2014 pick instead). Any non-MLB contract Bourn signs (e.g. Independent league, NPB, Korea, etc), would have no effect on his MLB status under the CBA.
